END USER LICENSE AGREEMENT

1. DEFINITIONS

Products refers to all audio samples, sound effects, sample packs, downloadable content, documentation, and updates provided by HorrorSound.org.

License means the license granted pursuant to this Agreement.

Media Productions refers to projects where the Products are synchronized with other media elements, including films, games, trailers, music, podcasts, apps, advertisements, videos, broadcasts, and interactive media.

2. LICENSE GRANT

HorrorSound.org grants the Licensee a non-exclusive, non-transferable, perpetual, single-user license for personal and professional use.

All Products are royalty-free for use in Media Productions.

2A. DIGITAL CONTENT AND REFUNDS

Due to the nature of digitally delivered Products, all sales are final once access to the Products has been granted or download has begun.

By purchasing the Products, the Licensee expressly consents to immediate digital delivery and acknowledges that any applicable right of withdrawal or cancellation may be lost in accordance with applicable consumer laws, including EU Directive 2011/83/EU.

3. RIGHTS GRANTED

The Licensee may install and use the Products on multiple devices owned and controlled by the same individual user.

Backup copies are permitted.

Distribution is allowed only when the Products are embedded within a larger Media Production and are not accessible as standalone files or extractable assets.

4. RESTRICTIONS

The Licensee may not:

• Redistribute, resell, sublicense, share, upload, or otherwise distribute the Products as standalone files.

• Create or distribute derivative sound libraries, sample packs, presets, or competing audio products derived from the Products.

• Claim ownership of the Products or any intellectual property contained therein.

• Use the Products in sound effect generators, AI-powered audio tools, or user-generated content platforms where end users may extract or access the raw files.

• Register, claim, or monetize the Products whether alone or in substantially unmodified form through any audio fingerprinting, content identification, or copyright management system, including but not limited to YouTube Content ID, Facebook Rights Manager, TikTok Rights Manager, Audible Magic, or similar services.

5. INTELLECTUAL PROPERTY RIGHTS

All Products remain the exclusive intellectual property of HorrorSound.org and its licensors.

Use of the HorrorSound.org name, logo, branding, or trademarks requires prior written permission.

6. PROHIBITION ON AI TRAINING

The Products may not be used for training, refining, developing, benchmarking, or improving artificial intelligence systems, machine learning models, generative audio systems, datasets, embeddings, synthetic audio tools, or related technologies.

Any such use constitutes a material breach of this Agreement.

7. TERMINATION

This License terminates automatically upon breach of any provision of this Agreement.

Upon termination, all use of the Products must cease and all copies must be destroyed.

8. MULTIUSER LICENSE

Each purchase includes a single-user license only.

Multi-user, enterprise, educational, or studio licenses must be purchased separately.

9. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, HorrorSound.org shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from the use or inability to use the Products.

10. INDEMNITY

The Licensee agrees to indemnify and hold harmless HorrorSound.org from any claims, liabilities, damages, or expenses arising from misuse of the Products or violation of this Agreement.

11. GENERAL

This Agreement is governed by the laws of Italy.

If any provision of this Agreement is found unenforceable, the remaining provisions shall remain in full force and effect.

This Agreement constitutes the entire agreement between the parties regarding the Products.
